1. INTRODUCTION
These Terms and Conditions govern the relationship between Massif Montane Expedition("we," "us," "our," "the Company") and any person or entity ("you," "your," "Client") booking or participating in activities, tours, expeditions, or services organized by Massif Montane Expedition in Uganda and East Africa. By making a booking with us, you agree to be bound by these Terms and Conditions.
2. BOOKING AND PAYMENT PROCEDURES
2.1 Booking Process
To secure your booking with Massif Montane Expedition, the following steps must be completed:
Submission of a completed booking form
Payment of the required deposit (as specified in section 2.2)
Receipt of our written confirmation of your booking
2.2 Payment Schedule
Deposit: A non-refundable deposit of 30% of the total tour cost is required at the time of booking to secure your reservation.
Final Payment: The remaining balance must be paid no later than 45 days prior to the
tour start date.
Late Bookings: For bookings made within 45 days of the departure date, full payment is required at the time of booking.
2.3 Payment Methods
We accept the following payment methods:
Bank transfers (all bank charges to be covered by the Client)
Major credit cards (Visa, Mastercard) subject to a 3.5% processing fee
Cash payments (USD, EUR, GBP, UGX) at our office in Sipi
Mobile money transfers (for East African residents)
2.4 Price Confirmation
All prices are quoted in US Dollars (USD) unless otherwise specified. Once your booking is confirmed with a deposit, your tour price is guaranteed against any increase, except for:
Government action or increases in taxes/national park fees
Extreme currency fluctuations (exceeding 10% from the time of booking)
Amendments you request to your original booking
3. CANCELLATION AND REFUND POLICY
3.1 Cancellation by Client
Should you need to cancel your booking, the following cancellation fees will apply:
More than 60 days before departure: Loss of deposit (30% of total tour cost)
45-60 days before departure: 50% of total tour cost
30-44 days before departure: 75% of total tour cost
Less than 30 days before departure: 100% of total tour cost (no refund)
All cancellations must be made in writing and are effective from the date we receive your
written notification.
3.2 Modifications by Client
Requests to modify your itinerary must be submitted in writing.
Changes made more than 45 days before departure will incur an administration fee of $50 per person plus any price difference for the modified arrangements.
Changes made within 45 days of departure will be treated as a cancellation andrebooking, and cancellation charges will apply.
3.3 Cancellation by Massif Montane Expedition
We reserve the right to cancel any trip due to circumstances beyond our control, including but not limited to:
Insufficient participants for a scheduled group departure
Force majeure events (as defined in section 7)
Safety concerns
In such cases, you will be offered the following options:
Transfer to an alternative trip (price difference may apply)
Full refund of all monies paid to Massif Montane Expedition
Credit voucher for future travel valid for 24 months
Massif Montane Expedition is not responsible for any incidental expenses you may have
incurred as a result of your booking, such as visas, vaccinations, or non-refundable flights.
3.4 Unused Services
No refunds will be made for any unused services, accommodation, or features of your trip
once the trip has commenced. This includes services missed due to late arrival or early
departure.
4. TRAVEL INSURANCE
4.1 Mandatory Requirement
Comprehensive travel insurance is MANDATORY for all clients traveling with Massif
Montane Expedition. Your insurance must cover:
Emergency medical expenses and repatriation (minimum coverage $100,000)
Personal accident and illness
Helicopter rescue and air ambulance (particularly for mountain expeditions)
Trip cancellation and curtailment
Personal liability
Personal belongings and money
4.2 Proof of Insurance
You must provide proof of your insurance policy details and emergency contact numbers to
our office no later than 30 days before departure. You will not be permitted to join the tour
without adequate travel insurance.
4.3 Recommendation
We strongly recommend obtaining insurance at the time of booking to cover potential
cancellation due to medical issues, flight cancellations, or other unforeseen circumstances.
5. HEALTH, FITNESS AND ABILITY
5.1 Client Responsibility
It is your responsibility to:
Ensure you are in good physical health and able to participate in the chosen
expedition or activity
Notify us of any medical conditions, allergies, or dietary requirements
Bring an adequate supply of any prescribed medications
Obtain necessary vaccinations and preventative medicines for the area you are visiting
5.2 Age Limitations
Minimum age: 12 years for standard tours; 15 years for mountain climbing
expeditions (accompanied by an adult)
Maximum age: No restriction provided you meet the fitness requirements for your
chosen activity
Clients over 65 years must provide a medical certificate confirming their fitness to
participate
5.3 Right to Decline
We reserve the right to decline, accept, or retain any participant at any time before or during
the trip if they fail to comply with these terms and conditions or if their mental or physical
condition or general behavior impedes the operation of the tour or affects the rights, welfare,
or enjoyment of other clients.
6. PASSPORTS, VISAS AND DOCUMENTATION
6.1 Client Responsibility
It is entirely your responsibility to ensure that:
Your passport is valid for at least 6 months beyond your intended departure date from
Uganda
You have obtained the necessary visas for all countries visited
You have received the required vaccinations and health certificates
6.2 Assistance
While Massif Montane Expedition will provide general information about visa and passport
requirements, we are not responsible for any issues arising from your failure to obtain the
correct documentation.
7. FORCE MAJEURE
7.1 Definition
"Force Majeure" means any event which Massif Montane Expedition or its suppliers could
not foresee or avoid, including but not limited to:
War, threat of war, riot, civil strife, or terrorist activity
Industrial dispute or strike
Natural or nuclear disaster, fire, or adverse weather conditions
Epidemic or pandemic
Government restrictions or actions
Technical problems with transportation
Closure of airports or any other exceptional circumstances beyond our control
7.2 Consequences
In the event of Force Majeure:
We reserve the right to modify or cancel any trip or itinerary at any time
If a trip is cancelled before departure, we will offer either an alternative trip or a
refund
If a trip is cancelled after departure, we will refund any recoverable costs for the
unused portion of the trip
Additional costs incurred due to Force Majeure (e.g., extra accommodation,
transportation) will be the responsibility of the client
8. RISK ACKNOWLEDGMENT
8.1 Inherent Risks
Adventure travel and mountain expeditions by their nature involve an element of risk. By
booking with us, you acknowledge that:
The decision to participate is made of your own free will
You understand the potential hazards involved in adventure travel, including injury,
illness, death, property damage/loss, and delays
You accept these potential risks as part of your expedition experience
8.2 Waiver
Prior to commencing your trip, you will be required to sign a Liability Release Form
acknowledging these risks and waiving certain legal rights, including the right to sue under
certain circumstances.
9. COMPLAINTS AND FEEDBACK
9.1 During Your Trip
If you have a complaint during your trip, you must promptly notify your guide/tour leader or
our local representative, giving them the opportunity to resolve the matter on the spot.
9.2 After Your Trip
If you remain dissatisfied, you must submit a written complaint to us within 28 days of the
end of your trip. Complaints received after this period will only be considered in exceptional
circumstances.
9.3 Resolution
We will acknowledge your complaint within 14 days and provide a full response within 28
days of receipt.
10. PHOTOGRAPHY AND TESTIMONIALS
10.1 Company Use of Images
We reserve the right to take photographs or videos during your trip and use them for
promotional purposes. By participating in our tours, you consent to allow your image to be
used in such photography. If you prefer not to be photographed, please inform your guide at
the beginning of the tour.
10.2 Client Feedback
We may use any feedback or testimonials you submit in our marketing materials, unless you
expressly request otherwise in writing.
11. WILDLIFE AND NATURAL PHENOMENA
We make every effort to maximize opportunities to view wildlife and natural phenomena
(including waterfalls), but we cannot guarantee sightings or optimal conditions as these are
dependent on weather, season, and natural factors beyond our control.
12. RESPONSIBILITY AND LIABILITY
12.1 Our Commitment
Massif Montane Expedition is committed to:
Operating safe, enjoyable, and memorable expeditions
Providing services as described in our itineraries
Ensuring our suppliers maintain reasonable standards
12.2 Limitation of Liability
Our liability to you will be limited to a maximum of the total cost of your booking with us.
We accept no liability for:
Acts or omissions of third parties or suppliers
Circumstances where performance is impossible due to Force Majeure
Any loss of enjoyment or disappointment
Personal items and belongings
Activities undertaken that are not included in the itinerary
13. APPLICABLE LAW AND JURISDICTION
These Terms and Conditions shall be governed by and construed in accordance with the laws
of Uganda. Any disputes arising in relation to these terms or your booking shall be subject to
the exclusive jurisdiction of the Ugandan courts.
14. AMENDMENTS TO TERMS AND CONDITIONS
Massif Montane Expedition reserves the right to update these Terms and Conditions at any
time. Any changes will be posted on our website and will apply to all new bookings made
after the date of posting.
